Both Bjorn and Katrina have represented claimants (successfully!) in the new refugee determination process. As a result we have the following information:
1. No screening package/form, country conditions disclosures, certificate of readiness or list of exhibits will be provided in advance of the hearing.
The RPD continues to rely on the country NDP. If the RPD requires the claimant to attempt to obtain personal or claim-specific documents in advance of the hearing, the request comes in the form of a letter. The list of exhibits is provided at the start of the hearing.
2. In the case of POE claims, all other application documents except for the BoC are completed at the POE and signed by the claimant(s). Copies should be provided to the claimant, but were not in the single POE case we have had so far. They had to be requested from CIC and took several days to arrive. As the BoC must be completed in 15 days, the absence of the other application docs was a problem.
3. CIC is once again splitting the front end of the process for inland claims. Notification and provision of completed application forms, photos and travel/ID documents can be made simultaneously at Harry Hayes. If everything checks out, a date will then be given for the eligibility interview. At present, there is an approximate one week's wait for the eligibility interview
4. As a result of the expanded criteria for CBSA and CIC intervention in refugee claims, expect to see Ministerial interventions on refugee claim files more often, if only in written form.
