This Memorandum (redacted) deals with manifest errors of law by the Refugee Protection Division. This matter was consented to by the Department of Justice, obviating the need to obtain leave from the Federal Court. Manifest errors: Download redact_memorandum.pdf

This Memorandum (redacted) deals with a situation where the RPD requested a material document which was provided by way of post-hearing disclosure, but then proceeds to write a decision as if the document was not provided. I'm happy to say that we've also met with some success with 'overseas' H&C applications. As these are highly fact specific, I encourage you to contact my office and see whether this is a possibility for you. Overseas H&C applications typically deal with exceptional cases, sometimes involve inadmissibility and are generally a final recourse to individuals who cannot enter Canada 'normally' and are wishing to enter Canada and can demonstrate undue and disproportionate hardship.
